Terms of Service
The Dispatcher is operated by RJones LLC. In these terms, "we" and "us" mean RJones LLC.
These terms govern use of The Dispatcher. By signing in or using the service you agree to them on behalf of yourself and the company you work for (the "organization"). If you do not agree, do not use the service. Our handling of data is described in the Privacy Policy.
1. The service
The Dispatcher is dispatch software for trucking companies: load and driver tracking, messaging, documents, phone and email tools, and an AI assistant. Features change over time, and some depend on accounts the organization connects.
2. Accounts and access
You sign in with your work email address. Keep your sign-in secure and do not share it. The organization is responsible for who has an account, what role each person has, and for having people removed who should no longer have access.
3. Acceptable use
- Use the service only for lawful business purposes and in line with the laws that apply to your operations, including rules on calls, texts, faxes and email to outside parties.
- Do not misuse it: no attempts to break into it, probe other organizations' data, overload it, or reverse engineer it; no sending spam, harassment, or deceptive messages.
- Do not put in data you have no right to use, and do not use it to harm drivers, brokers or others.
4. The AI assistant gives suggestions
The assistant can make mistakes. Its answers, drafts, matches and summaries are suggestions that you must read and check before relying on them. The service asks for a person's approval before certain actions (for example messages to outside parties or booking a load). You are responsible for what you approve, including approvals made by voice where the organization has turned that on. Approving something means you have reviewed it.
5. Outbound communications
The organization is responsible for the calls, texts, faxes and emails sent from its account, including their content, having permission to contact the recipients, and honoring opt-outs and quiet hours. Messages follow the settings the organization chooses. The text-message program is described in section 13.
6. Credentials and connected services
The organization supplies its own accounts and keys (for example its AI provider, phone carrier, email and load-board logins) and is responsible for them, for the charges those providers make, and for following those providers' terms. You confirm you may authorize us to use them. We store them encrypted and use them only to run the features you turn on. Connecting a Google account is also subject to the Google data commitments in the Privacy Policy.
7. Your data
The organization keeps ownership of its data. It gives us the right to process that data only as needed to provide the service and as described in the Privacy Policy.
8. Availability
The service is provided "as is" and "as available". We do not promise it will be uninterrupted, error-free or always accurate, and it depends on third-party providers we do not control. Do not rely on it as the only way to handle safety-critical or time-critical matters.
9. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special or consequential damages, or for lost profits, lost loads, missed pickups or deliveries, or business interruption, arising from use of the service, including from AI output or third-party outages. Our total liability for any claim is limited to the amount the organization paid us for the service in the three months before the claim arose. Nothing here limits liability that cannot be limited by law.
10. Termination
The organization may stop using the service at any time. We may suspend or end access if these terms are broken, if use puts the service or others at risk, or if required by law. On request we will help the organization export its data (see the Privacy Policy), and we delete data we are not required to keep.
11. Changes
We may update these terms; the date at the top shows the latest version. Continuing to use the service after a change means you accept it.
12. Governing law
These terms are governed by the laws of the State of Oregon, without regard to conflict-of-law rules. Disputes go to the state and federal courts located in Oregon.
13. Text messaging (SMS) program
This section describes the text-message (SMS) program available through The Dispatcher. It applies to text messages sent through the service and to the people who receive them.
- Program description: organizations use The Dispatcher to send text messages about freight orders and loads (for example pickup and delivery times, load status, rate and availability questions, and document requests) and to coordinate dispatch with brokers, shippers, receivers and drivers. The sender is the organization that uses the service (including RJones LLC for its own dispatch operations), from that organization's own phone number. The program is intended for business contacts in the freight industry.
- How consent is obtained: consent to receive texts is given verbally during a phone call. The caller or the person called is asked: "Would you like to receive text messages regarding order information?" A yes is the person's consent to receive order-related texts from that organization. A team member of the organization (or the AI assistant, when that team member tells it to) records the yes on the person's contact record in The Dispatcher: that it was a verbal yes on a call, who recorded it, when, and optionally which call. A no is recorded as declined. Consent records are kept for contacts (brokers, shippers and receivers); the service keeps no consent record for drivers.
- What the service does and does not enforce: the service stores and displays that record. It does not itself ask the question on a call, and it does not refuse to send a text because no yes is recorded; the organization is responsible for having permission before it texts someone (section 5). The service does not act on a recorded no either; the record is for the organization's own use. An organization may send sales texts to business contacts it has not yet spoken to; when the first text the service sends to a number is a sales text, it names the sender and says how to opt out. Whatever the record says, a recipient's STOP is always honored.
- Message frequency: varies with the orders and loads you are involved in and with any outreach the organization runs; the organization sets it.
- Rates: message and data rates may apply.
- Opt out: reply STOP at any time to stop receiving texts (STOPALL, UNSUBSCRIBE, CANCEL, END and QUIT also work). You will normally get one confirmation text and no further texts after that, and the number is placed on the organization's do-not-contact list. Clear requests such as "please stop" or "don't text me again" are treated the same way. To start receiving texts again, reply START; an owner or admin of the organization can also release the number after the person agrees again.
- Help: reply HELP to a text, or email themasterdispatcherboss@gmail.com.
- Carriers: carriers and phone companies are not liable for delayed or undelivered messages.
- Your information: mobile phone numbers and text-message consent are not shared with third parties or affiliates for marketing or promotional purposes. A number and message are passed only to the phone carrier that delivers the message and to the providers described in the Privacy Policy (including the AI model provider the organization chose, when an AI feature uses the message).
